PRIVACY POLICY

FIRST THINGS FIRST!

Use of jackiecooksanddrinks.com (hereinafter “this site” or “our site”), including all materials included herein, is subject to the following terms and conditions. These terms and conditions apply to all site visitors. By using this site, you agree to these terms and conditions in full.

COPYRIGHT & INTELLECTUAL PROPERTY

This site contains intellectual property owned by jackiecooksanddrinks.com, including trademarks, copyrights, proprietary information, and other types of intellectual property. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of this website, content or intellectual property, in whole or in part, without our prior written consent.

(Psst! This is Jackie, here. I spend a LOT of time working on this site— sometimes to the detriment of my husband and kids, even! So I really, really care that the recipes I’ve tested (over and over and over again) and all of the other content I’ve created here is mine…ALL MINE!! [insert evil laugh here.] No, seriously, I think of this site as my baby, so I’m as protective of it as I would be of…well, a baby! Thank you for respecting my recipes/art/content/whatever else you’d call the stuff I post on this site. Oh, and by the way—if you ever want to re-publish or distribute anything of mine, just email me and I’ll do what I can to help! I’m not a complete monster!)

INFORMATION WE COLLECT…AND WHY WE NEED IT

Our site typically collects two kinds of information about you: (i) personally identifying information that you provide to us; and (ii) information we automatically collect when you visit our site or that you provide to us that does not identify you. Occasionally, we may require personally-identifiable information to use certain features of our services. For instance, we may ask for an email address to subscribe to one of our newsletters or to create an account that will allow you to comment on the site. We never share or sell any of your personally identifiable information with any sponsors or

advertisers. As for your part—and this is really serious stuff—you are prohibited from impersonating someone else or providing account information or an email address that belongs to anyone else but you. And your account must not be used for any illegal or unauthorized purpose.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string—this last bit of information helps us detect spam.

This site is affiliated with Google AdSense for the purposes of placing advertising on the site, and Google, LLC will collect and use certain data for advertising purposes. To learn more about Google’s data usage, click here.

COOKIES…mmmm…oh wait, not that kind of cookies. If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies—opting in saves this information for one year. This is 100% for your convenience—so you don’t have to keep filling in your details every time you leave a comment. We may also allow our business partners to place cookies on your device. For example, we use both Google Analytics and MonsterInsights for web analytics, and they may also set up cookies on your device. We use cookies for a variety of reasons:

  • to enable, facilitate and streamline the functioning of our sites across different webpages and browser sessions;

  • to simplify your access to and use of our site and make it more seamless;

  • to monitor and analyze the performance, operation and effectiveness of our site, so we can improve and optimize it; and

  • to show you content that we think you’ll really love (think of it like we’re getting to know you better!)

Our site may also use other technologies with similar functionality to cookies, such as web beacons and tracking URLs to obtain anonymous data about users. We may also use web beacons and tracking URLs in our messages to you to determine whether you have opened a certain message or accessed a certain link.

DISABLING COOKIES
Most browsers automatically accept cookies, but you can modify your browser setting to turn off cookies. If you choose to decline or turn off our cookies (gasp!), it’s totally ok, we won’t hold it against you. Just know that some interactive features of our site may not function properly.

ABOUT THAT DATA OF YOURS…
Safety first! We treat your information like it’s our information. We have implemented security measures to protect against the loss, misuse and alteration of the information under our control. While we strive to protect your personally identifiable information and privacy, however, we can’t guarantee or warrant the security of any information you disclose or transmit to us online. But since we’ve taken what we consider to be reasonable and appropriate steps to keep your information safe, we are not responsible for the theft, destruction or inadvertent disclosure of your personally identifiable information. In the event that your “personally identifiable information” (as the term or similar terms are defined by any applicable law requiring notice upon a security breach) is compromised, we may notify you by email (in our sole and absolute discretion) to the last email address you have provided to us in the most expedient time reasonable under the circumstances. Some delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system, as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our site where applicable, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they can’t change their username). Site administrators also get to see and edit that information. If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that

we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Also, robots don’t cook and drink. We try to keep spam-bots out to make everyone’s time on this site more enjoyable. So, visitor comments may be checked through an automated spam detection service.

Oh, and a word to the wise: If you upload images to the site, you should avoid uploading images with embedded location data included. Visitors to the site can download and extract any location data from images on the website.

OPT-OUT AND CONTACT INFORMATION
Don’t hesitate to contact us as at [email protected] if: (i) you have questions or comments about this Privacy Policy; (ii) you wish to make corrections to any personally identifiable information you have provided; (iii) you want to opt out of receiving future commercial correspondence, including emails, from us. We will respond to your request and, if appropriate, make the requested change in our active databases as soon as practicable.

negligence, contract, tort, or any other theory of legal liability. The foregoing applies even if jackiecooksanddrinks.com has been advised of the possibility of or could have foreseen the damages. In those states that do not allow the exclusion or limitation of liability for the damages, jackiecooksanddrinks.com‘s liability is limited to the fullest possible extent permitted by law. You shall provide jackiecooksanddrinks.com with such assistance, without charge, as may be requested in connection with any such defense, including, without limitation, providing information, documents, records, and reasonable access to you, as we deem necessary. OTHER LEGAL STUFF
This agreement shall be governed by the laws of the United States of America and the Commonwealth of Massachusetts, applicable to agreements made and to be performed therein without regard to conflict of laws principles. You irrevocably consent and waive all objection to personal jurisdiction and venue in the state and federal courts located in Middlesex County, Massachusetts, and you shall not commence or prosecute any suit or action except in the foregoing courts.

If any term, provision, covenant, or condition of this agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

AFFILIATE PROGRAMS

We are a participant in the Amazon Services LLC Associates Program program, an affiliate advertising program designed to provide a means for us to earn fees by linking to Amazon.com and affiliated sites. As part of this program, jackiecooksanddrinks.com can post customized links, provided by Amazon.com, to track the referrals to their websites. This program utilizes cookies to track visits for the purposes of assigning commission on these sales. On occasion, jackiecooksanddrinks.com will participate in other, non-specified, affiliate programs, which have the same capabilities and utilize them to assign commission on these sales.

SPONSORED CONTENT
We occasionally get opportunities to work with brands and companies by creating a recipe using a specific product, hosting a giveaway, or—very rarely— reviewing a product. (Psst!! Jackie here, again! I just want to let you know that even when we are compensated, we will be 100% honest in our opinions. We will only share products that we believe in and are a good fit for jackiecooksanddrinks.com and its audience. And, we do our absolute best to verify any product claim, statistic, quote or other representation

about a product or service with the manufacturer, provider or party in question. If you know me at all, you know I like to keep shit REAL. And since you’re on my site, I’m guessing you do, too.)

ADVERTISING
Our site may use third parties, such as network advertisers, to serve advertisements on our site, and may use traffic measurement services to analyze traffic on our site. Network advertisers are third parties that display advertisements based on your visits to our site and other websites you have visited. Third-party ad serving enables us to target advertisements to you for products and services we think you’d want to know about. Our site’s third-party ad network providers, the advertisers, the sponsors and/or traffic measurement services, may themselves set and access their own cookies and other technologies on your computer and track certain behavioral information regarding users of your computer via an IP address or other device identifier. These third-party cookies and other technologies are set to, among other things: (i) help deliver advertisements they think you might like to see; (ii) prevent you from having to see the same advertisements too many times; and (iii) help them learn how useful the advertisements that they’ve delivered to you are. Note that any images (or any other parts of a web page) served by third parties in association with third-party cookies may serve as web beacons, which enable third parties to carry out the previously described activities. Third-party cookies, web beacons and other third-party technologies are governed by each third party’s specific privacy policy—not this one.

Here’s how to opt out of third-party tracking on our site:

  • ▪  You can learn how to opt out of the Google ad network by clicking here.

  • ▪  To opt-out of having interest-based information collected during your visits to this or other websites, both the National Advertising Initiative (the “NAI”) and the Digital Advertising Alliance (the “DAA”) offer opt-out tools to assist you in managing your choices. EMBEDDED CONTENT FROM THIRD-PARTY WEBSITES
Articles on this site may include embedded content (e.g. videos, images, articles, etc. from other sites). Embedded content from other sites behaves in the exact same way as if the visitor has visited the other website. These sites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
